Mumbai: A body massager cannot be categorised as an adult sex toy and cannot be included in list of items prohibited for import, Bombay HC said.

 A division bench of Justices Girish Kulkarni and Kishor Sant quashed an order passed by the Customs confiscating consignments containing body massagers. Commissioner of Customs had confiscated the goods claiming that body massagers could be used as adult sex toys &such items are prohibited for import. Opining that a massager could be used as an adult sex toy was clearly the figment of imagination of the Customs commissioner, HC observed.

 It dismissed a petition challenging a May ’23 order passed by Central Excise and Service Tax Appellate Tribunal whereby Customs order confiscating consignments containing body massagers was set aside. PTI
